Article 2 — Applicability
These terms apply to every offer on berryhot.eu and to every (pre-)order and agreement between BerryHot and a customer ("you"). By placing a (pre-)order you accept these terms.
Article 3 — The product
BerryHot is a small-batch artisanal spicy strawberry marmalade. As it is handmade in batches, appearance, colour and consistency may vary slightly between jars. Allergen and ingredient information is shown on the product and label.
Article 4 — Pre-orders
A pre-order reserves jars from an upcoming batch. No payment is taken at the time of a pre-order. When stock is ready we contact you with an expected ship date and a secure link to complete payment. If we cannot fulfil your pre-order, you are under no obligation and are not charged.
Article 5 — Prices and payment
All prices are in euros and include VAT. Prices may change, but the price confirmed at the moment of payment applies to your order. Payment is made through our secure third-party payment provider.
Article 6 — Delivery
We aim to ship within the timeframe stated at checkout to the address you provide. Stated delivery times are indicative. Risk of loss passes to you on delivery.
Article 7 — Right of withdrawal
See our Returns & Right of Withdrawal page. As a perishable food product sold sealed for hygiene, our marmalade is in principle excluded from the statutory 14-day right of withdrawal once delivered or unsealed.
Article 8 — Conformity and complaints
Your order must match its description and be of satisfactory quality. If an item arrives damaged, defective or incorrect, contact us via our Contact page within a reasonable time and we will arrange a replacement or refund. We aim to respond to complaints within 14 days.
Article 9 — Liability
BerryHot's liability is limited to the value of the order, except where the law does not allow such limitation (e.g. intent, gross negligence, or statutory product liability). Always check the label before consuming if you have allergies.
Article 10 — Applicable law and disputes
Dutch law applies. Consumers may also use the European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr).
