Article 2: Applicability
These terms apply to every offer on berryhot.eu and to every order and agreement between Berry Hot and a customer ("you"). By placing an order you accept these terms.
Article 3: The product
Berry Hot is a small-batch Strawberry Jalapeño Topping. As it is handmade in batches, appearance, colour and consistency may vary slightly between jars. Allergen and ingredient information is shown on the product and label.
Article 4: Orders
An order is complete when payment is confirmed and you receive an order confirmation by email. That confirmation is the agreement between you and Berry Hot. Because jars are made by hand in small batches, an item may occasionally prove unavailable after ordering. If Berry Hot cannot fulfil your order, you are refunded in full and charged nothing.
Article 5: Prices and payment
Prices are set in euros and include VAT. If you choose another currency in the country selector, prices are converted from euros at the current exchange rate, and checkout shows the amount and currency you pay before payment. Prices may change, but the price shown at checkout is the price that applies to your order. Payment is made through our secure third-party payment provider.
Article 6: Delivery
Berry Hot ships from the Netherlands to the countries listed on our Shipping page, which also sets out each country's delivery charge and free-delivery amount. Delivery typically takes three to eight days. We aim to ship within the timeframe stated at checkout to the address you provide. Stated delivery times are indicative. Risk of loss passes to you on delivery.
Article 7: Right of withdrawal
You have 14 days from delivery to withdraw from your purchase without giving a reason, for jars that are still sealed. A jar whose seal has been broken cannot be returned, for health and hygiene reasons (BW art. 6:230p). How to withdraw and how refunds work is set out on our Returns & Right of Withdrawal page.
Article 8: Conformity and complaints
Your order must match its description and be of satisfactory quality. If an item arrives damaged, defective or incorrect, contact us via our Contact page within a reasonable time and we will arrange a replacement or refund. We aim to respond to complaints within 14 days.
Article 9: Liability
Berry Hot's liability is limited to the value of the order, except where the law does not allow such limitation (e.g. intent, gross negligence, or statutory product liability). Always check the label before consuming if you have allergies.
Article 10: Applicable law and disputes
Dutch law applies. Consumers may also use the European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr).
